Legal Learning Session: Mental Capacity Act: the new code of practice

The Mental Capacity Act (MCA) code of practice is being updated in light of new legislation and case law, changes in organisational structures and terminology, as well as developments in ways of working and good practice. The government published an updated draft code of practice for public consultation in March and this session will explore what this means for practice.

Learning outcomes: 

  • The latest learning on mental capacity assessments from relevant case law, with a particular focus on the more difficult areas of the MCA.
  • The main changes being brought in by the new code of practice that affect capacity assessments and the implications they will have on practice.
  • What it will mean in future when talking about acting in the best interests of someone who lacks capacity.
